RON WILSON V. NORBRECK LLC
Ron Wilson was a notorious frequent-flier of ADA cases who was allegedly disabled by fibromyalgia and several other infirmities. Mr. Wilson filed a lawsuit that alleged 66 ADA violations in a Johnny Carino's Restaurant. We filed a successful motion for summary judgment and had 58 of those violations removed from the lawsuit and went to trial on the 8 remaining claims. Among them, Mr. Wilson claimed that the wicker trashcan in the men's restroom was a barrier to access to the clear floor space under the sin. Fortunate, the wise and Honorable David F. Levy agreed with the defense that because Mr. Wilson was strong enough to lift his own wheelchair out of the back of his truck, a small wicker trashcan was not a credible barrier to access.
